PLAINTIFF: Your Honor, everyone knows that nobody reads the Terms of Service. It’s a EULA — you see a wall of text and automatically click the Accept button.

PLAINTIFF: In fact, not reading the Terms of Service is a social norm. It is, in other words, the expected behavior. So by placing their privacy policy in their Terms of Service, they are actually trying to hide their policy!

PLAINTIFF: And since they are trying to hide their policy within the mechanism they use to force users to comply with their policy, they are, therefore, committing fraud!

JUDGE: I haven’t quite worked through his argument, but given that he’s accusing you of fraud I’m inclined to overlook the confusing bits.
